These general conditions of sale (GTC) govern, exclusively, the contractual relations between Rose de Bagatelle, hereinafter referred to as “RdB” (Siret number: 538 315 508 00035) and any person, hereinafter referred to as “The customer” who places an order on the merchant website hereinafter referred to as “the site”, via the following address: www.rosedebagatelle.com.
These general conditions of sale, systematically brought to the knowledge of each Customer when placing the order, are applicable to all articles offered for sale on the site, and are reserved for customers legally able to subscribe contracts concerning goods and services offered on the site. Consequently, the fact of placing an order implies the full and unreserved acceptance of the Customer to these general conditions of sale as well as to the tariffs applied. These conditions prevail over any other document as well as on the general conditions of sale of the country of the Customer.
Any condition to the contrary posed by the customer will be, in the absence of express acceptance, inopposable to RdB whenever it may have been brought to its knowledge.
Any failure by RdB to fulfill one or more of its obligations mentioned in these general conditions of sale may under no circumstances be interpreted by the Customer as a waiver of the general conditions of sale.
These terms and conditions may be updated or changed without notice. The conditions applicable will then be those in force at the time of the conclusion of the contract, that is to say on the date of registration of the order.

The lack of availability of the product does not in any case incur the responsibility of RdB nor does it give right to the payment of damages in favor of the Customer. - Price of the articles

The advertised prices are valid as long as they are displayed on the product sheets of the articles to which they refer. RdB reserves the right to modify the prices of the items at any time and undertakes to apply the tariff in force at the time of the validation of the order, always subject to the availability of the product ordered on this date.
Any change in the applicable VAT rate will be reflected in product prices. After this date, they are subject to change at any time. However, prices will be unchanged once the order is placed by the customer. ABOUT THE ORDER
The order is only made on the website of RdB (www.rosedebagatelle.com). The Customer must fill in an order form called “Basket” by selecting the references of the selected products as well as the quantities desired.
All orders are considered validated by the Customer, at the moment when the Customer ticks the box “Accepts cgdv”. This constitutes an irrevocable acceptance by the Customer of the present general conditions of sale, which replaces a handwritten signature, and can not be disputed.
At the time of the order, the Customer agrees to provide the information requested and commits on the veracity of these. All these details are necessary to establish an invoice and to manage the logistics aspects (delivery):

The Customer is advised to keep all the documents relating to his order until the completion of the order.
Non-execution of the order:
RdB reserves the right not to confirm an order for any reason whatsoever, such as product supply, a problem with the order received (ex. its readability), a suspicious order, or a probable problem for the delivery to be carried out. RdB undertakes to inform the Customer by means of a method of contact indicated by the Customer.
RdB reserves the right to refuse any request from a Customer with whom a payment dispute is in progress, or from a Customer signaled by our partners as at risk or using fraudulent means of payment.
Any new order can be accepted only to the extent that the Customer will be up to date with the payment of his previous orders.
RdB can not be held liable for non-performance of the contract in case of stock shortage or unavailability of the product, force majeure, disruption or strike, partial or total, of the shipping services. The payment is made under the conditions stipulated at the time of the order. The cost of the delivery costs is borne by the Customer and is paid by him at the time of the order.

Payment can be made either by the Customer:

The parcels are shipped from Monday to Friday following an order validated and settled (either by credit card directly on the site in payment Paypal, or cashing the check or credit transfer), except holidays, otherwise stated and subject to availability some products.
All orders placed between Friday 12:00 am and Sunday evening will be processed from the following Monday, except holidays.
The Customer will be informed of the date of picking up the parcel by the carrier.
The delivery is retained as soon as the product is delivered to the Customer.
Delivery times are indicated as accurately as possible. Exceeding delivery times can not give rise to a claim for damages. RdB can not be held liable in case of excessive delivery time due to transport services, or in the event of a strike by the latter. Except as otherwise provided in these Terms and Conditions of Sale, delivery charges shall always be borne by the Customer. The delivery does not include the installation, assembly, commissioning of the ordered product or the taking back of any material whatsoever.
RdB reserves the right to cancel an order in case of difficulties too great for the carrier to execute the delivery.

- Delivery France
The standard delivery is made on French territory within the time limit provided by the direct delivery of the product to the advertised recipient. This delivery takes place in 2 or 3 working days in France.
- International delivery
Parcel delivery is possible in most European countries (Andorra, Austria, Belgium, Denmark, Finland, Germania, Holland, Ireland, Italy, Luxembourg, Lichtenstein, Norway, Portugal, Spain, Sweden).
Unless otherwise provided, parcels shall be sent by post. The delivery times are 3 to 6 working days for Europe, 5 to 10 working days for the rest of the world, depending on the country of destination.
For destinations such as Great Britain, Switzerland, Greece, USA, Canada, Eastern Europe, Australia, Brazil, Argentina, Chile … the Customer must contact customer service before placing his order in order to accurately estimate the costs of delivery.
The import formalities, customs duties and any taxes related to the delivery of an article outside the European Union are the responsibility and are exclusively the responsibility of the Customer.
Any return of the product must be the subject of a prior agreement between the seller and the buyer.
RdB takes special care in packaging products to minimize the risk of breakage. RIGHT TO RETRACT

PROPERTY RESERVES AND RISK TRANSFER
The transfer of ownership of the products to the benefit of the Customer will be realized only after the complete payment of the price by the latter, whatever the date of delivery of the said products.
